Адвокат кооператива считает, что экспертиза подтверждает позицию "Бест Вей"
Совет потребительского кооператива "Бест Вей" официально получил результаты бухгалтерской экспертизы деятельности кооператива, проведенной в декабре прошлого года ФБУ "Северо-Западный региональный центр судебной экспертизы" Министерства юстиции России по поручению следственной группы (есть в распоряжении редакции).

Адвокат кооператива, член коллегии адвокатов "Первая адвокатская контора" города Санкт-Петербурга Сергей Путреша считает, что по содержанию бухгалтерская экспертиза СЗРЦСЭ Минюста России как раз полностью опровергает концепцию следствия о том, что "все украдено". Согласно результатам экспертизы, "процент соотношения израсходованных денежных средств на приобретение недвижимого имущества к общему объему поступивших на расчетные счета ПК "Бест Вей" денежных средств составляет 80%". "Замечу, что буквально каждая проводка кооператива подтверждена документами либо о приобретении недвижимости, либо об оказании услуг кооперативу", – подчеркивает адвокат.

"Экспертиза фактически подтверждает нашу позицию, – говорит адвокат Путреша, – Позицию, которую мы отстаиваем с первого дня, когда кооператив попал в орбиту уголовного разбирательства: кооператив никого не обманывал и не вводил в заблуждение – он работал ровно так, как заявлял".

"Согласно результатам экспертизы, в кооператив с момента его создания в 2014 году поступило более 16 млрд 187 млн рублей, – замечает Сергей Путреша, – Мы, наконец, узнали, откуда новая цифра ущерба, заявленная следствием: 16 млрд 187 млн рублей, вдруг возникшая в документах вместо прежней суммы – 155 млн рублей. Ущерб, с точки зрения следствия, равен сумме всех поступивших в кооператив средств за весь период деятельности кооператива с 2014 года. Логика, как я понимаю, такова. Следствие пришло к выводу, что в кооперативе все незаконно, все деньги, которые находятся на счетах, все квартиры, в которых живут пайщики – все похищено. Следственная группа просто так решила – подменяя собой суд. Кооператив "Бест Вей", напомню, законно действующая организация, официально зарегистрированная, все изменения устава которой также были зарегистрированы налоговой инспекцией. Организация, официально получавшая материнский капитал, в том числе выигрывавшая суды о предоставлении материнского капитала, имеющая налоговую льготу в Республике Башкортостан, предоставленную региональным законодательным собранием. Организация, ни одним судебным актом не признававшаяся незаконной".

"Экспертиза регионального центра Минюста фактически свидетельствует: мошенничества в деятельности кооператива не обнаружено, – подчеркивает адвокат. – Видимо, это одна из причин, по которой мы увидели экспертизу только в середине весны 2023 года, хотя она была проведена в декабре 2022-го. Будем опираться на нее в защите интересов кооператива".

Своё личное мнение высказывает председатель коллегии адвокатов «Первая адвокатская контора» города Санкт-Петербурга, президент Адвокатской палаты Ленинградской области, вице-президент Федеральной палаты адвокатов Российской Федерации, адвокат одного из обвиняемых Денис Лактионов.
Происходит безобразие, откровенный произвол! Следователи ГСУ ГУ МВД России по Санкт-Петербургу и Ленинградской области, по мнению адвокатов обвиняемых, грубо нарушили права семи обвиняемых, в том числе шести находящихся в СИЗО, возможности которых осуществлять защиту своих прав и без того крайне ограничены. Не дали даже толком прочитать тексты постановлений о привлечении в качестве обвиняемых, не говоря уже о том, чтобы понять прочитанное, — не предоставили предусмотренные законом возможности. А это документы на 69–73 листах.

Следственная группа составляла обвинения месяцами, а тут не дают даже полчаса, для того чтобы прочитать. Однако ведь и полчаса мало. Большие сложные тексты: с цифрами, со сложными логическими построениями, насыщенные юридической терминологией. Все это требует не просто пробежаться глазами, но еще и осмыслить, провести анализ вместе со своими адвокатами. А после этого уголовно-процессуальный закон предусматривает дачу показаний обвиняемого. Ничего этого сделано не было.

Одной из обвиняемых предоставили всего 15 минут для ознакомления, другие успели прочитать 15–20 страниц, прежде чем ознакомление было прекращено. Другой обвиняемой предъявили новое обвинение, но отказались выслушать ее показания по нему, несмотря на заявленное ходатайство.

В большинстве представленных в заявлении адвокатов случаев не был проведен допрос по существу обвинений. В одном случае протокол допроса составили задним числом с указанием, что обвиняемый и адвокаты отказались его подписать, хотя допрос на самом деле не проводился. Причем на требование ознакомиться с протоколом допроса следователь ответил отказом.

Всем обвиняемым не было разъяснено содержание обвинений, они не были ознакомлены с результатами экспертиз, на основе которых выдвинуто обвинение.

Таким образом, обвинение не предъявляется так, как должно быть предъявлено. По сути дела, обвиняемые лишены следователями права на защиту! Ведь, для того чтобы защищаться, нужно знать, в чем тебя обвиняют.

Я считаю, что действия следователей не имеют ничего общего с уголовно-процессуальным законом, а должны. Более того, следователи несут за это ответственность как государственные должностные лица, которые уполномочены действовать по закону, а они грубым образом нарушают закон.

Поэтому появилось заявление защитников, в присутствии которых нарушались права подзащитных, и, естественно, самих защитников, потому что это и права защиты: права защитников на осуществление защиты, определенные Федеральным законом «Об адвокатской деятельности и адвокатуре». Адвокатам не дают осуществлять конституционное право на защиту, на оказание квалифицированной юридической помощи.
